Consignor/Donor Agreement

Thank you for consigning/donating with Heather’s HandUps. Before we can help you re-sell your clothing, shoes, accessories, select books, toys, household goods, accessories or other items not listed, please read and confirm your acceptance of our consignment/donation agreement. You will agree to the terms, statements and conditions of this agreement as written below, upon signing.

WHAT WE ACCEPT 

Garments, shoes, accessories, books, toys, household goods, accessories, décor, or any other item not listed, which Heather’s HandUps agrees to sell in our store. The consignor/donor agrees that all consigned/donated items are in excellent condition, laundered, dustless, odorless, from a smoke-free environment, spot free, and ready to be received by Heather’s HandUps. Beautifully mended items are fine! Heather’s HandUps reserves the right to refuse any items in its sole discretion. 

WHAT WE DO NOT ACCEPT

Underwear, large heavy appliances or furniture (due to mobility and space issues), animals, items that must be left outside, stained and soiled goods, or items with foul odors. We do not accept firearms as we are not a licensed broker and do not have the ability to verify background or verify that the firearm has not been reported stolen. This list is not all inclusive. Heather’s HandUps reserves the right to refuse any items in its sole discretion.

HOW IT WORKS    

 All potential consignments and donations must be approved and accepted before they are put up for sale. Items may be dropped off at our store, but appointments are highly recommended and are required for new consigners. If items are dropped off, and left, they will be considered a donation and become absolute property of Heather’s HandUps and will be used at the discretion of Heather’s HandUps.

If items are brought in, through appointment, any items rejected may be taken back by the consignor. Anything not taken back, Heather’s HandUps will take absolute ownership of and donate them to other local organizations. At no time will Heather’s HandUps reject an item, brought in for consignment, and then attempt to sell said item.

An already established consignor may obtain permission to drop off items for consignment. Details and terms will be agreed upon at that time.

The consignor is paid 50% of the item sale price.  

10% of the sale price will be donated, via vouchers, to the local Community Action Agency. Heather’s HandUps will donate 10% of all total sales in the store, as stated above, regardless whether it was consignment or donation.

Donors that wish to take part in our Philanthropy Initiative waive their 50% commission in favor of gifting it to the charitable organization supported, by Heather’s HandUps at the time of their item’s sale. It is Heather’s HandUps goal to keep all salvageable items moving in a helpful manner, through Hand-Ups and not just end up as trash.

It is the responsibility of the consignor/donor to update Heather’s HandUps of any changes to their contact details.  

CONSIGNMENT/DONATION STOCK PERIOD AND TERMINATION 

Heather’s HandUps accepts consignment and donation items for all seasons, year-round and reserves the right to hold consigned/donated items for a period of six (6) months prior to putting out for sale. For the purposes of this agreement, the first day a consigned/donated item is put out for sale by Heather’s HandUps will be considered as the “consignment date” in our system.  

If a consigned or donated item is not sold within 120 days of the consignment date, the unsold item will become the absolute property of Heather’s HandUps and will be donated at the sole discretion of Heather’s HandUps without further obligation or liability to the consignor/donor. Heather’s HandUps donates unsold items to carefully vetted charitable organizations that benefit our local community.

PRICING 

Heather’s HandUps reserves the right to determine the prices for any consigned or donated items, in its sole discretion. All items are priced to sell quickly.

 

PAYMENT                                                                                                                 

The consignor may select the following options for payment:

- Store credit in the form of a voucher.

-Cash in store with proof of ID. (for payouts over $150, a paper check will be written).

- Paper check sent by mail to the address on file.

- Electronic payment via PayPal or Zelle

OR

-Donation to the charitable organization being supported at the time of payment.

Payments are disbursed monthly between the 3^rd and the 5^th of each month, paying for sales made in the month prior.

LIABILITY 

Heather’s HandUps will not be responsible, directly or indirectly, to the consignor/donor for any loss, damage or theft to consigned/donated items. If a consigned/donated item is destroyed or damaged by fire or other casualty, this agreement will automatically terminate without any further obligation or requirement of Heather’s HandUps. All risk of ownership of consigned/donated items will remain with the consignor/donor for the duration of this agreement.  Heather’s HandUps disclaims any warranties or representations about the safety or suitability of the consigned/donated items. Heather’s HandUps further disclaims any warranties or representations with respect to experience or expertise in manufacturing, repairing, or inspecting merchandise for safety, ease of use, or fitness for a particular purpose and therefore disclaims any responsibility for recalls, defective merchandise, or safe usage for any purpose.                  

OTHER LEGAL STUFF                                                                                             

- No alteration or amendment to this agreement will take effect unless it is in writing duly executed and agreed upon by both the consignor or donor and Heather’s HandUps.  

-This agreement will be governed by and construed in accordance with the laws of the state of Missouri.

- The provisions of this agreement constitute the entire agreement between the consignor/donor and Heather’s HandUps and supersede all previous communications, representations and agreements, whether oral or written, between the consignor/donor and Heather’s HandUps with respect to the subject matter of this agreement.
